How to Ensure Compliance with Hong Kong’s Health Product Regulations

Table of Contents

Importing dietary supplements or health-related products into Hong Kong involves adhering to specific regulatory requirements. The type of license you need depends on the ingredients of your product. If your supplement contains pharmaceutical ingredients, you’ll need to apply for a Wholesale Dealer License for Medicines. If not, you may only need a Food Import License. This guide will walk you through the steps to ensure a smooth and compliant importation process.

Step 1: Verify Ingredients - Is It a Pharmaceutical Product?

The first step in the process is to determine whether your supplement contains pharmaceutical ingredients. According to Hong Kong’s regulations, any product containing medicinal ingredients must be registered as a pharmaceutical product.

  • If your supplement includes pharmaceutical ingredients, you must apply for a Wholesale Dealer License for Medicines.
  • If your supplement does not contain pharmaceutical ingredients, you can proceed to apply for a Food Import License.

Step 2: Apply for a Food Importer / Food Distributor License

If your supplement does not contain pharmaceutical ingredients, you need to apply for a Food Importer / Food Distributor License with the Hong Kong Centre for Food Safety (CFS). To do so, you will need the following documents:

  • Business Registration Certificate: A copy of your valid business registration certificate.
  • Hong Kong Identity Card: A copy of the valid identity card for individuals.
  • Proof of Identity: A copy of a valid proof of identity document.

Step 3: Submit Your Application and Pay the Fees

Once you have gathered the necessary documents and completed the application form, submit your application to the CFS. The registration fee for a 3-year license is HKD 195.

  • Application Submission: After submitting your documents, you will typically receive a payment note within 7 working days.
  • Application Review: The FEHD will review your application, which may take between 4 to 6 weeks. Additional due diligence may be required in some cases.

Step 4: Compliance and License Renewal

Maintaining compliance with Hong Kong’s food safety regulations is crucial for operating legally. The Food Import License is valid for 3 years, and you must apply for renewal before it expires to avoid any disruption in your business.

  • Record-Keeping: Ensure that you maintain detailed records of your transactions and follow all safety regulations.
  • Renewal Process: Apply for renewal before the license expires to continue importing and distributing supplements without interruptions.

Conclusion

Successfully navigating the importation process for supplements in Hong Kong is relatively straightforward when you follow the correct steps. By understanding whether your product falls under pharmaceutical regulations or food import regulations, you can apply for the appropriate licenses.
