For entrepreneurs, startups and SMEs, Small Business Relief UAE can significantly simplify Corporate Tax compliance. Importantly, the relief has now been extended: under Ministerial Decision No. 131 of 2026, eligible businesses may claim it for qualifying Tax Periods ending on or before 31 December 2029, while the AED 3 million revenue threshold remains unchanged. 

What Is Small Business Relief in the UAE?

Small Business Relief is an elective treatment under the UAE Corporate Tax regime for eligible Resident Persons with limited revenue. When properly elected, the business is treated as having no Taxable Income for that Tax Period. 

It is not a permanent Corporate Tax exemption. 

It is also different from the standard 0% Corporate Tax rate on Taxable Income up to AED 375,000. Under Small Business Relief, an eligible business is treated as having no Taxable Income for the elected period, rather than simply applying a 0% rate to part of its taxable profit. 

Who Can Qualify for Small Business Relief UAE?

The relief is available to qualifying Resident Persons, including resident juridical persons and natural persons who are subject to UAE Corporate Tax. 

Key conditions include: 

  • Revenue must be AED 3 million or less in the relevant Tax Period. 
  • Revenue must also have been AED 3 million or less in every previous Tax Period. 
  • The election must be made separately for each eligible Tax Period. 
  • The relevant Tax Period must start on or after 1 June 2023 and end on or before 31 December 2029. 
  • Revenue should be determined using the applicable accounting standards accepted in the UAE. 
  • A Taxable Person must still meet applicable Corporate Tax registration and filing obligations. 

For individual freelancers and sole proprietors, remember that a natural person generally enters the UAE Corporate Tax regime only where turnover from UAE Business or Business Activities exceeds AED 1 million in a calendar year. 

Who Cannot Claim the Relief?

UAE Small Business Relief is not available to: 

  • Qualifying Free Zone Person. 
  • A member of a multinational enterprise group with consolidated group revenue exceeding AED 3.15 billion. 

A Free Zone company is therefore not automatically excluded simply because it operates in a Free Zone; the specific exclusion applies to a business treated as a Qualifying Free Zone Person. 

Businesses should also avoid artificially dividing activities between entities to remain below the AED 3 million threshold. The Ministry of Finance states that artificial separation may fall within the Corporate Tax general anti-abuse rules. 

How Does Small Business Relief Work in Practice?

An eligible business elects for the relief through its Corporate Tax Return. It is then treated as having no Taxable Income for that Tax Period and may submit a simplified return. Registration and filing obligations do not disappear. 

Businesses electing the relief cannot simultaneously use other Corporate Tax exemptions, reliefs and deductions for that period. Transfer pricing documentation requirements are simplified, although transactions with Related Parties and Connected Persons must still follow the arm’s-length principle. 

Checks to Make Before Making the Election

Before claiming Corporate Tax relief for small businesses UAE, review: 

  • total revenue for the current and all previous Tax Periods; 
  • whether the AED 3 million threshold has ever been exceeded; 
  • Corporate Tax registration status; 
  • accounting records supporting reported revenue; 
  • Free Zone or multinational-group status; and 
  • whether Small Business Relief is preferable to claiming other available deductions or reliefs. 

The FTA requires eligible businesses to keep sufficient records supporting their revenue and entitlement to the relief. Corporate Tax Returns and any tax payable are generally due within nine months after the end of the Tax Period. 

Eligibility should be reassessed every year. Once revenue exceeds AED 3 million in a Tax Period, Small Business Relief is unavailable for later Tax Periods even if revenue subsequently falls below the threshold. 

Simple Example

A UAE mainland consultancy earns AED 2.2 million in its 2025 Tax Period and AED 2.8 million in 2026. Assuming it is a Resident Person, has never exceeded AED 3 million in a previous Tax Period and meets the other conditions, it may elect for Small Business Relief for 2026. 

If its revenue later reaches AED 3.4 million in 2027, it cannot claim the relief for 2027 or subsequent periods.

Do not assess eligibility based only on this year’s sales. Review historical Tax Period revenue, Corporate Tax status, Free Zone classification and group relationships before making the election. Businesses close to the AED 3 million threshold should maintain particularly accurate revenue records.
